Lawmaker wants evidence dismissed at his DUI trial

Roger Hernandez.JPGAssemblyman Roger Hernandez (D-Los Angeles County) is scheduled to go to trial in Walnut Creek Tuesday on drunk driving charges in connection with his wee hours arrest outside a Concord hotel in March. Capitol Alert reports that he’ll ask a judge to throw out a blood analysis and other evidence against him Monday, on the eve of trial.

From Capitol Alert:

Lab tests concluded his blood-alcohol level was 0.08 percent, the level at which a motorist can be charged with drunken driving. Hernández has apologized for any embarrassment he may have caused others, but he said that he drank only two glasses of wine between 9 p.m. and the time of his arrest, about 2 a.m.
