State lawmaker cleared of drunk driving in Concord case

Assemblyman Roger Hernandez, the Los Angeles County Democrat, was found not guilty of drunken driving today. The jury, which was not told that Hernandez was a state lawmaker (presumably so as not to predispose jurors against him) hung on whether the lawmaker’s blood alcohol level was 0.08 percent. Hernandez was pulled over along with a 29-year-old female passenger about 2 a.m. on March 27. He failed a field sobriety test. He said he was in the Bay Area to visit a friend. Capitol Alert
