Alameda: No legal duty to save man that first responders watched drown

Friday, February 8, 2013

Here’s something guaranteed not to make you feel warm and fuzzy. (That’s a familiar photo of the scene at the so-called “slow motion drowning” captured by the Oakland Local blog.) The family is seeking damages in court, and yesterday an attorney for the city argued that while it was a “tragic, unfortunate situation,” first responders were under no legal duty to try and save the man’s life.
