Lawyer for accused gang rapist: Wind may have blown DNA at crime scene

The dual jury trial of two of the accused perpetrators in that horrific 2009 gang rape of a 16-year-old Richmond High School student outside a homecoming dance began with the unveiling of a novel defense argument. The lawyer for Marcelles Peter, now 20, says that the wind may have transferred his client’s DNA from a beer can to a broken used condom found near the scene.

From the Contra Costa Times [brackets mine]:
"I don't think we will ever know all that happened," [defense attorney Gordon] Brown said in his opening statement, after urging jurors to "keep an open mind."
